SMS Privacy Policy

1. Scope

This Policy applies to BidBuyZoom’s text-messaging program for bidders and other individuals who take part in auctions and sales on BidBuyZoom. It applies whether or not the recipient purchases or subscribes to BidBuyZoom.

Consent to the messaging program is given separately for each auction company, and messages are sent only about the auction companies a recipient agreed to receive messages about. Consent given for one auction company is never used for messages about another.

If you opt in to the BidBuyZoom messaging program, message frequency varies depending on your account activity, bids, sale results, invoices and payments, security events, and customer-support needs. Message and data rates may apply according to your mobile carrier and service plan. You may opt out at any time by replying STOP or request assistance by replying HELP.

2. Information we collect

In connection with the messaging program, we may collect:

• Your mobile telephone number;
• Your name and bidder account identifiers;
• The auction company each consent is for, and the date, time, source, method, and recorded version of that consent;
• Your opt-in, opt-out, and help requests;
• Message content and responses;
• Delivery status, timestamps, carrier information, and error data;
• Bid, lot, sale, invoice, payment, support, and account information needed to generate or respond to messages;
• Technical and security information reasonably necessary to operate, protect, troubleshoot, and document the program.

3. How we use SMS information

We may use SMS information to:

• Send messages you requested or agreed to receive;
• Provide account, bidding, sale, invoice, payment, security, and customer-support notifications;
• Process and document consent, opt-out, and help requests for each auction company;
• Confirm, before each message, that you agreed to messages about the auction company it concerns;
• Respond to questions and support requests;
• Route relevant service communications within BidBuyZoom;
• Maintain suppression records so opt-outs are honored;
• Monitor delivery, prevent misuse, troubleshoot errors, and secure the messaging program;
• Maintain records demonstrating compliance and satisfy legal obligations.

4. How we disclose SMS information

BidBuyZoom may provide limited SMS information to vendors that help operate the program, including telecommunications carriers, messaging-platform providers, hosting providers, security providers, and support providers. These providers may use the information only to perform services for BidBuyZoom and must protect it under appropriate restrictions.

When a message concerns an auction or sale run by an auction company using BidBuyZoom, relevant message content or status may be available within that company’s authorized BidBuyZoom account solely to run the auction or sale, respond to the recipient, or maintain appropriate records. This does not transfer the recipient’s SMS consent to that company for independent marketing or promotional messages.

We may also disclose information when required by law or legal process, to protect rights or safety, to investigate fraud or misuse, or as part of a corporate transaction subject to appropriate protections. Any successor remains subject to the restrictions applicable to SMS opt-in data and consent.

5. No sale or marketing sharing

Mobile telephone numbers, SMS opt-in data, and SMS consent will not be sold, rented, transferred, or shared with third parties or affiliates for their marketing or promotional purposes. SMS opt-in data and consent are not transferable, are not shared between auction companies, and will not be treated as consent for messages about any other auction company or for another company’s independent messages.

BidBuyZoom does not use SMS opt-in information for cross-context behavioral advertising.

6. Retention

We retain SMS information for as long as reasonably necessary to operate the program, provide requested communications, honor opt-out requests, maintain security and audit records, resolve disputes, and comply with legal obligations. We may retain a mobile number on a suppression list after an opt-out so the request continues to be honored.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect SMS information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your choices

You may opt out at any time by replying STOP, which stops messages about every auction company. To stop messages about one auction company only, turn off text messages in Settings on that company’s BidBuyZoom site. For assistance, reply HELP, use our contact form, or email support@bidbuyzoom.com.

Depending on your location and applicable exceptions, you may have rights to request access to, correction of, or deletion of personal information. Submit requests through our contact form or by email to support@bidbuyzoom.com, with “Privacy Request” in the message.

9. Children’s privacy

The messaging program is not directed to children under 13, and BidBuyZoom does not knowingly seek SMS consent directly from children under 13. Contact us if you believe a child provided mobile information improperly.

10. Changes to this Policy

We may update this Policy to reflect changes in the program, our practices, or applicable requirements. We will post the revised version with a new effective date and provide any additional notice required by law.
